SORA Hearing Victory
Mr. Kaufman’s client, in a sexual offense, had a Sexual Offender Registration Level Determination at a hearing in New York County Supreme Court. Mr. Kaufman’s client scored a Level 2 on the Risk Assessment Instrument and the prosecution asked the Court to upwardly depart to a Level 3. Mr. Kaufman argued that the Court should downwardly depart to a Level 1, which would keep the client’s information off the internet, as a result of an exceptional response to treatment. The Court found that Mr. Kaufman had met his burden to prove that his client’s response to treatment was exceptional and allowed for Mr. Kaufman’s client to be registered at Level 1.
